If you are selling food products, you may need a kitchen approved by the local health department. I imagine they would expect your business to be registered. In many counties, all you need to do is go into the County Clerks offic to set up a DBA (Doing Business As)  

This gives you the right to advertise using the business name and also a copy of this would be accecpted by most banks for setting up a business account. 

I think this costs about $15. Where I live and is good for 5 years. Make sure to renew it before it expires or someone else might be able to take your business name.

But even if you come up with a kick A name someone could use that same name to start a corporation and they could then insist you stop using it.
